Adapta\u00e7\u00e3o de Textos<\/strong>

<\/td><\/tr>
Posso registrar uma adapta\u00e7\u00e3o ou tradu\u00e7\u00e3o origin\u00e1ria de uma obra intelectual pr\u00e9-existente?<\/strong>

Segundo a Lei 9.610\/98, a tradu\u00e7\u00e3o e a adapta\u00e7\u00e3o s\u00e3o consideradas formas de transforma\u00e7\u00f5es da obra origin\u00e1ria e para tal a mesma Lei prescreve: \u201c(…) depende de autoriza\u00e7\u00e3o pr\u00e9via e expressa do autor a utiliza\u00e7\u00e3o da obra, por quaisquer modalidades (…)\u201d. No entanto, essas altera\u00e7\u00f5es n\u00e3o devem se constituir em \u201cmodifica\u00e7\u00e3o\u201d da obra origin\u00e1ria, que \u00e9 uma prerrogativa exclusiva dos direitos morais do autor. Sendo assim, para o registro da adapta\u00e7\u00e3o ou tradu\u00e7\u00e3o origin\u00e1ria de uma obra intelectual pr\u00e9-existente, considerada uma nova cria\u00e7\u00e3o intelectual, \u00e9 necess\u00e1rio que o autor (tradutor ou adaptador) apresente autoriza\u00e7\u00e3o expressa do autor da obra original, com firma reconhecida. Essa exig\u00eancia n\u00e3o \u00e9 necess\u00e1ria caso a obra original tenha ca\u00eddo em dom\u00ednio p\u00fablico.
